SNATCHO is a product owned by KOOBA GAMES SAS.
2. Purpose and scope
These Terms of Sale govern purchases made directly on playsnatcho.com by consumers acting for purposes outside their trade or profession.
Customers must have the legal capacity required to place an order.
Purchases made on Amazon and pledges made through Kickstarter are subject to the terms applicable to those channels, without affecting mandatory consumer rights. These Terms of Sale do not govern those transactions.
The applicable version is the version provided to the customer when placing the order. Subsequent changes do not apply to contracts already concluded.
3. Products and availability
Essential product characteristics, contents, language, recommended age, and applicable warnings are presented on the product pages before purchase.
Customers should consult this information to check that the product meets their needs.
Photographs and illustrations represent the products as accurately as possible. Minor differences in presentation must not affect the agreed characteristics or the customer’s statutory conformity rights.
Products are offered subject to availability.
If a product becomes unavailable after an order is placed, we will inform the customer as soon as possible. We will not impose a substitute product. If the order cannot be fulfilled, amounts paid for unavailable products and associated charges will be refunded without undue delay.
Where an offer is expressly identified as a preorder, its preorder status and delivery date or timeframe are stated before payment.
4. Prices and delivery charges
Prices are displayed in euros, inclusive of applicable taxes, according to the order and its destination.
Delivery within France
Standard delivery charges are included in the displayed price for orders delivered within France.
If an additional paid delivery option is offered, its price is shown before payment and requires the customer’s agreement.
Delivery to other European Union countries
Additional delivery charges apply to orders delivered to other European Union countries.
These charges are calculated according to the destination and available delivery options and displayed before the order is finally confirmed.
The order summary shows the total amount payable, including products, taxes, and any additional charges. No additional charge may be imposed after the contract is concluded without the customer’s agreement.
Prices may change, but products are charged at the price accepted when the order was placed.
5. Ordering and formation of the contract
To place an order, the customer:
-
Selects products and adds them to the cart.
-
Checks the contents of the cart.
-
Provides the information required for billing and delivery.
-
Reviews the delivery arrangements, delivery timeframe, and total price.
-
Reads and accepts these Terms of Sale.
-
Confirms the order using a button clearly indicating an obligation to pay.
Before confirmation, the customer can check and correct the information entered.
Final confirmation of the order, subject to acceptance of payment, forms the sales contract. A confirmation is sent to the email address provided by the customer.
This confirmation contains the essential order information. These Terms of Sale and withdrawal information are provided on a durable medium that allows the customer to retain them.
If the customer notices an error, they should contact us promptly. We will consider possible corrections according to the order’s preparation status, without restricting statutory rights.
6. Payment
The total price is payable in full when the order is placed.
Payments are processed through Shopify Payments, PayPal, and the payment methods actually offered at checkout.
An order cannot be fulfilled if payment is declined. The customer may use another available payment method or contact their payment provider.
Security checks may be necessary to prevent fraud. These checks must remain proportionate and respect the customer’s rights.
7. Delivery areas and arrangements
Delivery is offered to addresses within the European Union that are served and accepted during checkout.
Any territorial restrictions or unavailable delivery options must be disclosed before payment.
Order preparation and dispatch may be handled by Amazon Multi-Channel Fulfilment (MCF) and its delivery providers.
KOOBA GAMES SAS remains responsible to the customer for proper fulfilment of the order. Using Amazon or a carrier does not transfer that responsibility to the customer.
Delivery timeframes
The applicable delivery date or timeframe is communicated before the order is confirmed and included in the contractual information.
This timeframe includes preparation and transportation. Providing a tracking number does not, by itself, constitute delivery.
If no delivery date or timeframe has been agreed, delivery will take place without undue delay and no later than thirty days after the contract is concluded, in accordance with the law.
Late or missing deliveries
If delivery is delayed, the customer may contact contact@koobagames.com.
Under the conditions provided by the French Consumer Code, the customer may require us to deliver within a reasonable additional period and then terminate the contract if delivery does not occur within that period.
Immediate termination is available in the circumstances provided by law, including where we refuse to deliver or the delivery deadline was an essential condition of the contract.
When the contract is terminated for failure to deliver, amounts paid will be refunded within fourteen days of termination.
Receipt and transfer of risk
The risk of loss or damage passes to the customer when they, or a third party designated by them other than the carrier, take physical possession of the products.
If the customer independently appoints a carrier other than those offered by us, the specific statutory rules applicable to that situation apply.
We encourage customers to check the parcel and its contents upon receipt and report any problems to us. Failure to record reservations with the carrier does not remove the customer’s rights against us.
8. Statutory right of withdrawal
Consumers have fourteen days, starting the day after receiving the products, to notify us of their decision to withdraw, without giving a reason.
Where several items from one order are delivered separately, the period begins upon receipt of the last item.
If the deadline falls on a Saturday, Sunday, public holiday, or non-working day, it is extended to the next working day.
Exercising the right
Customers may notify us:
-
By email to contact@koobagames.com;
-
By post to the address below;
-
Through the online withdrawal function provided on the website;
-
Using the model form attached to these Terms, although this is not compulsory.
Any unambiguous statement expressing the decision to withdraw is acceptable. Exercising the right does not require our prior approval.
Where a statement is submitted through the online withdrawal function, an acknowledgement is sent without undue delay on a durable medium.
Returning products
Products must be dispatched within fourteen days of the withdrawal notification to:
KOOBA GAMES SAS — SNATCHO Returns
6 Chemin de la Chire
65670 Monléon-Magnoac
France
The customer is responsible for the direct cost of return shipping for a change of mind.
Customers should protect the products adequately for transportation and retain proof of dispatch.
Product condition
Opening a game box does not automatically remove the statutory right of withdrawal.
Customers may handle the product as necessary to establish its nature, characteristics, and functioning. They may be responsible for any reduction in value resulting from handling beyond those checks.
Products should be returned with their components and accessories. Using the original packaging is recommended but is not an absolute condition for exercising the right.
Discounted and promotional products benefit from the same statutory rights.
Refunds
We refund the relevant amounts, including original standard delivery charges where charged, within fourteen days of receiving the withdrawal notification.
We may withhold the refund until we receive the products or evidence that they have been dispatched, whichever occurs first.
Additional charges for a more expensive delivery option chosen by the customer are not refunded.
Where standard delivery was included in the product price, no initial shipping cost that was not separately charged will be deducted from the refund.
For partial returns, delivery charges are refunded to the extent required by applicable law.
Refunds use the original payment method unless the customer expressly agrees to another method without additional charges.
Any deduction for a reduction in value will be justified and explained.
9. Additional 30-day return offer
In addition to the statutory right of withdrawal, KOOBA GAMES SAS offers, at no additional charge, a return option lasting until the thirtieth day after receipt, for orders covered by these Terms.
For requests made after the statutory withdrawal period has expired, games must be:
-
Unopened, with their original packaging still sealed;
-
Complete and in perfect condition;
-
Accompanied by proof allowing us to identify the purchase.
Customers must send their request to contact@koobagames.com no later than the thirtieth day after receipt and dispatch the products within fourteen days of their request, following the arrangements communicated.
Return shipping costs are the customer’s responsibility. Refunds cover the price paid for accepted products and are issued within fourteen calendar days of receiving them and checking that the conditions are met.
Original delivery charges billed separately are not refunded under this additional offer. No standard delivery cost included in the product price is deducted.
This offer does not restrict statutory guarantees. A withdrawal notified within the statutory period remains governed by statutory rules, even if the return takes place after day fourteen.
10. Statutory guarantees
KOOBA GAMES SAS is responsible for applicable statutory guarantees, including the statutory guarantee of conformity and the statutory warranty against hidden defects.
To exercise these rights, customers may contact:
KOOBA GAMES SAS
contact@koobagames.com
6 Chemin de la Chire, 65670 Monléon-Magnoac, France
Telephone: +33 6 49 86 39 89
Change-of-mind return conditions, including the unopened-product requirement under the additional return offer, do not apply to statutory guarantees.
Statutory guarantee information — English translation of Annex A to Article D. 211-2 of the French Consumer Code
Consumers have two years from delivery of the goods to exercise the statutory guarantee of conformity if a lack of conformity becomes apparent. During this period, consumers need only establish the existence of the lack of conformity, rather than the date on which it arose.
Where the sales contract provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that content or service throughout the agreed supply period. During this period, consumers need only establish the existence of the lack of conformity affecting the digital content or service, rather than the date on which it arose.
The statutory guarantee of conformity requires the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity entitles consumers to repair or replacement within thirty days of their request, free of charge and without significant inconvenience.
If goods are repaired under the statutory guarantee of conformity, the original guarantee is extended by six months.
If the consumer requests repair but the seller requires replacement, the statutory guarantee of conformity is renewed for two years from the replacement date.
Consumers may obtain a price reduction while keeping the goods, or terminate the contract and receive a full refund upon returning them, if:
The trader refuses to repair or replace the goods;
Repair or replacement takes more than thirty days;
Repair or replacement causes significant inconvenience, particularly where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or the installation costs of repaired or replacement goods;
The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
Consumers are also entitled to a price reduction or termination where the lack of conformity is sufficiently serious to justify an immediate price reduction or termination. In that case, consumers do not have to request repair or replacement first.
Consumers are not entitled to terminate the sale if the lack of conformity is minor.
Any period during which goods are unavailable for use because of repair or replacement suspends the remaining guarantee period until the repaired or replacement goods are delivered.
These rights arise under Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs the exercise of the statutory guarantee of conformity may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover under Article L. 241-5 of the French Consumer Code.
Consumers also benefit from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This warranty entitles consumers to a price reduction if they keep the goods, or a full refund upon returning them.
11. After-sales service and complaints
For missing cards, damaged games, order errors, or any other difficulty, customers may write to contact@koobagames.com.
Please include the order number and a description of the problem. Photographs may help us resolve it, but they are not a general condition for exercising statutory rights.
Returns necessary to exercise a statutory guarantee are arranged at no cost to the consumer.
12. Liability
KOOBA GAMES SAS is responsible for properly performing its contractual obligations, including where performance is entrusted to service providers.
Our liability may be excluded or reduced only under the conditions provided by law, including where we demonstrate that non-performance is attributable to the customer, an unforeseeable and unavoidable act of a third party to the contract, or force majeure.
Nothing in these Terms restricts mandatory consumer rights, statutory guarantees, or liability that cannot lawfully be excluded.
13. Personal data
Information necessary to manage orders, payments, deliveries, and customer service is processed in accordance with our Privacy Policy.
Accepting these Terms does not constitute consent to marketing communications or optional tracking technologies.
14. Retention of the contract
We retain contractual documents in accordance with applicable legal obligations.
For electronically concluded contracts worth €120 or more, we ensure their retention and accessibility for the legally required period.
Customers may request access to their contractual documents by writing to contact@koobagames.com, subject to identity verification where necessary.
15. Consumer mediation
In the event of a dispute, customers may first submit a written complaint to contact@koobagames.com or our registered office.
Following a prior written complaint that remains unresolved, consumers may refer the dispute free of charge to the consumer mediator appointed by KOOBA GAMES SAS, subject to applicable admissibility conditions, including referral within one year of the written complaint.
Mediator: [NAME TO BE COMPLETED AFTER ENROLMENT]
Address: [TO BE COMPLETED]
Website and referral procedure: [TO BE COMPLETED]
Mediation does not remove the consumer’s right to bring proceedings before a competent court.
16. Applicable law and competent courts
These Terms are governed by French law.
This choice does not deprive consumers residing in another country of mandatory protections available under the law applicable to their circumstances, including the law of their habitual residence where the relevant legal conditions are met.
Disputes fall within the jurisdiction of the courts competent under applicable rules. Consumers are not required to bring proceedings exclusively before the courts where KOOBA GAMES SAS has its registered office.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
